FinecoBank will only process Personal Data obtained from the use of Profiling Cookies for the following purposes:

the promotion and sale of "dedicated" products and services of the Bank, Fineco Group companies or third-party companies, specifically identified through the processing and analysis, including through the use of automated techniques or systems, of information relating to preferences, habits, consumption choices, aimed at grouping data subjects based on specific behaviours or characteristics (customer profiling), also implemented through the enrichment of data (enrichment on the basis of any consents already provided in the context of the existing relationship with FinecoBank).The legal basis that legitimises the consequent processing is the consent of the Data Subject which they are free to give or not and which they can, in any event, revoke at any time.Failure to give this consent will not have any negative consequences, except for the inability to receive dedicated marketing communications.

RECIPIENTS OR CATEGORIES OF RECIPIENTS OF PERSONAL DATA

The natural and legal persons appointed as Data Processors and the natural persons authorised to process the data necessary for the performance of the tasks assigned to them may become aware of the data of the Data Subject, including:employees of the Bank or those seconded to it, temporary workers, personal financial advisers qualified for cold-calling, interns and consultants.

The Bank may communicate the personal data in its possession, without the consent of the Data Subject, to:

  • entities to whom such communication must be made to in order to comply with an obligation of law, regulations or EU law;
  • intermediaries to whom the data may be disclosed on the basis of the provisions of the anti-money laundering legislation (see Art. 39, paragraph 3 and paragraph 5, of Legislative Decree No. 231/2017), which provides for the possibility of the communication of personal data relating to reports considered suspicious, of additional information requested by the UIF or of the existence or probability of investigations or in-depth inquiries on money laundering or terrorist financing both between intermediaries belonging to the same Group and between two or more intermediaries not belonging to the same group but involved in cases relating to the same customer or the same transaction;
  • companies belonging to the UniCredit Group, and namely subsidiaries or affiliates pursuant to Art. 2359 of the Italian Civil Code (also located abroad), to whom such communication is permitted as a result of Italian Privacy regulations or a legal requirement.

RIGHTS OF DATA SUBJECTS

The current legislation on data protection assigns specific rights to the Data Subject, including that of knowing what personal data is held by the Bank and how it is used (Right of access), to obtain its updatingcorrection or, if there is interest, integration, as well as its cancellation, transformation into anonymous form or limitation.

Data Subjects may at any time revoke, where given, their consent to the storage of cookies on their device and to any processing of personal data resulting from the use of cookies, within the terms indicated in the "How to disable them" section.

HOW TO EXERCISE YOUR RIGHTS

To exercise their rights, all Data Subjects may contact the Bank:

  • by post to the address FinecoBank, Via Rivoluzione d’Ottobre 16, 42123 Reggio Emilia.

The term for reply is one (1) month, which may be extended by two (2) months in particularly complex cases; in such cases, the Bank shall provide at least one interim communication within one (1) month.

In principle, the exercise of rights is free of charge; the Bank, having assessed the complexity of processing the request and, in the event of manifestly unfounded or excessive (including repetitive) requests, reserves the right to charge a fee.

The Bank has the right to request further information necessary to identify the applicant.

DATA RETENTION PERIOD

Technical cookies: Some technical cookies are stored only for the duration of the session, others for a maximum period of 2 years.

TRANSFER OF DATA TO THIRD COUNTRIES

Personal data may also be transferred to countries outside the European Union or the European Economic Area (so-called "Third Countries") recognised by the European Commission with an adequate level of personal data protection or, otherwise, only if it is contractually guaranteed by all Fineco suppliers located in the Third Party Country an adequate level of personal data protection with respect to that of the European Union (e.g., by signing the standard contractual clauses provided by the European Commission) and that the exercise of the rights by data subjects is always ensured.

COMPLAINTS OR REPORTS TO THE ITALIAN DATA PROTECTION AUTHORITY

If a Data Subject believes their rights have been violated, they can make a complaint or submit a report to the Italian Data Protection Authority or bring a complaint before a judicial authority.
